Terms and conditions

The company STARELICS, a simplified joint-stock company (Société par Actions Simplifiée) with share capital of €1,000.00, registered with the Rennes Trade and Companies Register under number 943 381 863, whose registered office is located at 1, rue Ernest Renan, 35700 Rennes, France, represented by Paul EON in his capacity as President (hereinafter the “Seller”).
1. Scope
The Seller offers for sale collectible objects of “memorabilia” (the “Memorabilia”) that have belonged to individuals of recognized renown in fields such as, without limitation, culture, sports, science, education, or humanitarian work (hereinafter the “Celebrity”), on the website www.starelics.com (the “Site”).
These Terms and Conditions of Sale (the “Terms”) apply to every sale concluded between the Seller and any natural person acting as a consumer wishing to purchase the products (the “Customer”).
To place an order on the Site, the Customer must read and accept these Terms without reservation.
The Customer and the Seller are collectively referred to as the “Parties.”
2. Products
The Seller has entered into an arrangement with the Celebrity, who has authorized the Seller to sell one or more items belonging to them.
For each sale mandate, the Celebrity or public figure provides the Seller with a certificate of authenticity specifying the provenance and history of the Memorabilia.
No user of the Site may propose an item for sale.
Each item is described in detail and accompanied by photographs enabling the Customer to assess its physical characteristics.
3. Account
Access to and use of the Site are free of charge. To place an order, the Customer must create a single customer account by completing the registration form available on the Site and providing accurate, truthful, complete, and up-to-date information.
The Seller cannot be held liable for inaccurate, incomplete, or outdated information.
Login credentials (username and password) are unique, personal, and strictly confidential. The Customer agrees to use them personally and not disclose them to any third party.
4. Orders
The Customer represents that they have full legal capacity to contract with the Seller and in particular that they are of legal age and legally competent.
The Customer selects items on the Site and places them in their cart. Items placed in the cart are reserved for ten (10) minutes; if the order is not completed within this time, the items become available to other customers.
To complete the purchase, the Customer reviews the cart, clicks “Order,” enters personal information, selects a delivery method, and pays the displayed amount.
Order confirmation by the Customer constitutes an obligation to pay. The Customer receives a confirmation email summarizing the order and including the invoice, which constitutes the sales contract between the Parties.
Once validated, an order cannot be modified or canceled by the Customer except as provided by applicable consumer-withdrawal rights.
5. Prices and Payment
Prices are indicated in euros, all taxes included, at the VAT rate in effect on the order date. Any change in VAT will apply automatically.
The Seller may offer two types of sales:
* Decreasing-price sale: the Seller sets a starting price that decreases over time according to a schedule determined by the Seller;
* Fixed-price sale: a single price set by the Seller.
In both cases, the sale price is that shown when the Customer finalizes the order. Delivery fees are disclosed before order confirmation.
Accepted payment methods: credit card, Apple Pay, PayPal, Shop Pay.
6. Delivery
Memorabilia can be delivered to France, the European Union, and the United Kingdom. Delivery is handled by the Seller’s partner carriers, whose details are provided during checkout.
Delivery times are expressed in business days and are not guaranteed; delays do not give rise to compensation or penalties.
Delivery times are automatically extended in cases of force majeure or unforeseen events.
The Customer is responsible for the delivery address provided. Any parcel returned due to an incorrect or incomplete address will be reshipped at the Customer’s expense.
7. Retention of Title
Memorabilia remain the property of the Celebrity until full payment of the purchase price. If the Customer resells the item before full payment, the Celebrity’s claim automatically transfers to the resale proceeds. The Customer assigns to the Celebrity all receivables arising from such resale.
8. Claims and Right of Withdrawal
If a package is damaged, incomplete, or defective upon receipt, the Customer must notify the carrier and the Seller within three (3) days, providing evidence (photos or videos).
For distance contracts, the consumer Customer has fourteen (14) days from the day after delivery to exercise the right of withdrawal without giving reasons.
The Customer must notify the Seller by mail, email, or the Site’s form.
9. Warranties
9.1 Legal Conformity Warranty
In accordance with Articles L.217-3 et seq. of the French Consumer Code, the Seller guarantees the Customer against lack of conformity for two (2) years from delivery.
Any defect arising within that period is presumed to have existed at delivery unless incompatible with the nature of the item or defect.
Notification with evidence (photos/videos) must be sent to the Seller.
9.2 Hidden Defects Warranty
Under Articles 1641 et seq. of the French Civil Code, the Seller guarantees the Customer against hidden defects existing at delivery.
The Customer must notify the Seller and provide supporting evidence.
9.3 Limitations
Given the unique and irreplaceable nature of the items, replacement is not possible. Once non-conformity or a hidden defect is established, the Customer may choose repair or refund.
10. Returns and Refunds
After obtaining the Seller’s agreement, the Customer has fourteen (14) days to return the item to:

Return shipping costs and risks are borne by the Customer.
Only items returned complete, in their original condition with all accessories, unused and undamaged, will be accepted.
Refunds are issued within fourteen (14) days of either receipt of the returned item in acceptable condition or notification of withdrawal, using the original payment method unless otherwise agreed.
11. Liability
Each item is accompanied by a certificate of authenticity completed by the Celebrity or their authorized representative.
The Seller makes every effort to present accurate descriptions and photographs. The Customer cannot claim dissatisfaction based on personal error or omission.
Prices are set unilaterally by the Seller and may decrease over time.
The Seller is not liable for Internet-related failures, temporary Site unavailability, or force majeure as defined in Article 1218 of the French Civil Code.
The Seller is not liable for damage caused by the Customer’s negligence or unforeseeable actions of a third party.
12. Intellectual Property
All texts, images, and photographs on the Site are the exclusive property of the Seller and are protected worldwide by intellectual-property rights.
Any reproduction, distribution, modification, or exploitation without prior written consent is prohibited and may constitute infringement.
13. Personal Data
The Seller collects and processes personal data (name, postal address, email, telephone) for order processing, delivery, and billing.
Customers have rights of information, access, rectification, erasure, restriction, portability, objection on legitimate grounds, and withdrawal of consent.

14. Changes to the Terms
The Seller may amend these Terms at any time. Updates will be posted on the Site.
15. Governing Law and Dispute Resolution
These Terms are governed by French law.
The Parties will endeavor to resolve disputes amicably.
The Customer may refer the matter to a consumer mediator and may also use the European Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/.
